(I) The Quatsch Comedy Club is a brand of Serious Fun GmbH, Berlin (hereinafter: provider). These general terms and conditions apply to all business relationships between the provider and its customers (hereinafter: user).

(II) The contract between the provider and the user is concluded when the customer receives the order from the provider.

(III) The provider’s offer is aimed exclusively at private customers. If a customer orders tickets in the course of a commercial or independent professional activity, in particular acts as a reseller, the provider reserves the right to withdraw from the contract immediately.

(IV) The user is responsible for the correctness of the address data provided by him for the ticket dispatch.

(I) With the purchase of an admission ticket, the user acquires the right to one entry to a performance of the provider in Berlin or Munich.

(II) The purchased admission ticket will only be dispatched after the provider has received the full invoice amount. Tickets will be sent by email as a PDF attachment.

(I) The tickets are freely transferable and can be used by the respective holder.

(II) In the event of loss or theft of admission tickets, the provider assumes no liability for any unlawful redemption of an admission ticket. The regulations made under § 7 of these terms and conditions remain unaffected.

(III) The commercial resale of tickets is illegal.

(I) The validity of the ticket purchased is only valid for the day and the event for which it was issued.

(II) A cash payment for an admission ticket is not possible.

(III) If original tickets have already been issued and left at the box office and the user does not appear for the performance, the tickets expire without any right to a refund or replacement.

(I) The total price of the ordered admission tickets is due for payment immediately upon receipt of the contract confirmation. The amount is to be paid to the provider free of charge by bank transfer without any deductions.

(II) If the total price is not received on the account of the provider by the agreed payment term, the provider reserves the right to withdraw from the contract without further notice. The right to claim damages in the event of default in payment remains unaffected by these regulations.

(III) Ordered tickets will only be dispatched after receipt of full payment.

(I) All data and information given on the provider’s website, in particular about prices, time and place of the event, viewing options, program or cast, are without guarantee.

(II) The provider is liable in accordance with the statutory provisions insofar as the user asserts claims for damages based on intent or gross negligence, including intent or gross negligence on the part of the representatives or vicarious agents. Insofar as the provider is not accused of intentional breach of contract, liability for damages is limited to the foreseeable, typically occurring damage.

(III) The provider is liable in accordance with the statutory provisions if he culpably violates an essential contractual obligation; in this case, however, the liability for damages is limited to the foreseeable, typically occurring damage. Liability for culpable injury to life, limb or health remains unaffected.

(IV) Unless otherwise stipulated above, liability is excluded. In particular, the provider is not liable for damage caused by force majeure, riot, war and natural events, epidemics or other incidents for which the provider is not responsible (e.g. strike, power failure, traffic disruptions, maintenance or repair work as well as malfunctions in IT systems and Internet connections that are not operated by the provider).

(V) For technical reasons, the provider cannot assume any guarantee or liability for its availability by email or telephone or for the availability of http://www.quatsch-comedy-club.de/tickets. Furthermore, he does not assume any liability for the correctness and completeness of the data transmitted via the Internet.

(I) Any further liability for damages than provided for in § 7 – regardless of the legal nature of the claim asserted – is excluded. This applies in particular to claims for damages arising from negligence when concluding the contract, due to other breaches of duty or due to tortious claims for compensation for property damage in accordance with Section 823 of the German Civil Code (BGB).

(II) Insofar as the liability for damages towards the provider is excluded or limited, this also applies with regard to the personal liability for damages of the employees, workers, employees, representatives or vicarious agents.

The provider collects user data only insofar as this is necessary for the execution of the contract (inventory data), for the provision of services (usage data) or for billing (billing data). The user’s data are processed in strict confidence in accordance with the provisions of the Telemedia Act (TMG) and the Federal Data Protection Act (BDSG). A transfer to third parties is excluded, unless the user has expressly given his consent to receive a newsletter. By placing an order, the customer agrees to the storage and processing of his data for internal purposes. The user has the right to view the data stored about himself by the provider at any time free of charge.

The law of the Federal Republic of Germany applies to all legal relationships between the parties to the exclusion of the UN sales law.

Due to the current corona pandemic, we are currently called upon to follow special hygiene and distance rules. Therefore, the following special conditions apply during the period of the pandemic in addition to or deviating from the above provisions:

As a general rule

There is an obligation to show a 3 G proof (negative SARS-COV-19 test, proof of vaccinated or recovered) including photo ID.

We reserve the right to have another party at your table that evening.

If an event is canceled due to official orders, protective measures by the provider or other reasons related to the corona pandemic, the ticket price will be reimbursed to the customer in the form of a voucher.

The cloakroom cannot be left. Larger bags / luggage cannot be stowed. Coats can be taken into the theater.

People suffering from Covid-19 or people with typical corona symptoms are not allowed to take part in the event. People who have had contact with corona infected people in the last 14 days are not allowed to take part in the event. Attending the event is not recommended for people at increased risk who are not allowed to wear a mask.

Our staff has the right at their own discretion to refuse entry to people who appear ill. The entrance fee will be refunded.

When walking and standing, an FFP2 mask must be worn correctly over the mouth and nose. The mouth and nose protection can be removed when the seat is reached and while at the table. The masks are to be brought by the customer.

The safety distance is to be kept if possible.

Hand hygiene and sneeze labels must be observed.

When entering the house, the contact details are to be left. These data are collected in compliance with data protection regulations and deleted after four weeks.

If one of these rules is violated, the customer can be asked to leave the club.

Munich

Tickets can only be purchased online. We cannot grant discounts.

Berlin

The seats are reserved with a fixed table number. The reservation is made on the day of the event in accordance with the distance rules.

Discounts cannot currently be granted.

These regulations come into force on September 28, 2021 and override all previous regulations.
